Eolas Says Day Is Night, Loss Is A Win

Yesterday we had the story of Eolas apparently losing “round two” in their patent review battle. We noted, at the time, that the process is pretty complex, so it’s still a bit early to celebrate. However, it’s still a bit surprising today to see Eolas trying to spin yesterday’s story as good news for them. They claim that the original finding has been “withdrawn” and the points made in this finding apply to completely different prior art that Eolas believes they’ll effectively be able to explain away. Whether or not this is true, it’s yet another reminder that this is far from over — and since Microsoft is no longer allowed to argue for their side, Eolas has the ability to say whatever they want without a response.

.. perhaps all the sunlight on this case will expose Michael Doyle and his flunkies (David Martin, et al) as the greedy opportunists they are.
Unfortunately this won’t prevent others from trying the same dirty tricks but it might force them to think twice about suing for outrageous “damages”.
