Last year, we got a lot of positive feedback on our episode taking a look at the Consumer Electronics Show with the help of journalist Rob Pegoraro. So this year, we’ve brought Rob back for another look at the highs and lows of CES.

Exclusive offers, windowing, paywalls, etc. Funny how you resort to the very business models you mock incessantly. But, hey, you’re the guy who hires people with little to no understanding of IP to write articles where they embarrassingly get the basics wrong while drawing legal conclusions. It’s all good if they include the legal filing, though, right? You’ve got the internet down, my friend! #NerdHarder

If you think any of what you stated above is accurate, then it just shows you haven’t been paying attention. I guess, given your regular statements around here, isn’t much of a surprise.

When will you learn that arguing against the fake strawman you setup just makes you look silly?

You’re not making it available to everyone at the same time, a practice you condemn. You’re creating artificial scarcity, a practice you condemn. You’re creating deadweight loss, a practice you condemn. I can go on.

Instead of just saying my argument is wrong, EXPLAIN why it’s wrong. How are you not doing the very things you condemn? You haven’t explained this because you can’t. You are deflecting, not engaging.

And don’t think I didn’t notice that you don’t deny hiring people to reach legal conclusions about IP law that don’t even know the basics. I’d be embarrassed too!

I think he did provide some evidence. Aka the “you do the practices you condemn.” I think it’s a fair enough allegation to at least satisfy an initial burden of proof. I don’t think he needs to show “exact citations” to make his point. Also, the “citations or it didn’t happen,” while good generally, can also be used to deflect an argument instead of engaging in it.

I for one am genuinely curious why there is a special “members only club” that requires payment when most of the stuff on techdirt is about free things. This is what I want explained. Not with a link to something else, but a simple sentence or two. I think that is what the original commenter wants as well. Just a simple rebuttal instead of a “you clearly don’t understand” response.
